Contratar CLT, agregar um aut\u00f4nomo com ve\u00edculo, ou contratar o TAC independente por viagem.<\/p>\n<p>As tr\u00eas portas s\u00e3o legais. O problema \u00e9 que cada uma tem regras pr\u00f3prias, e o erro cl\u00e1ssico do setor \u00e9 contratar por uma porta e operar como se fosse outra: o &#8220;agregado&#8221; que cumpre hor\u00e1rio, usa uniforme e recebe ordem como empregado \u00e9 um processo trabalhista com data marcada.<\/p>\n<p>Este guia separa as tr\u00eas figuras, o custo real de cada uma e as regras de conviv\u00eancia que mant\u00eam o modelo em p\u00e9.<\/p>\n<p><strong>Na d\u00favida se a viagem precisa de CIOT?<\/strong> <a href=\"https:\/\/growthlog.com.br\/preciso-de-ciot\/\">Responda o assistente &#8220;Preciso de CIOT?&#8221;<\/a>: em at\u00e9 3 perguntas ele diz se precisa, quem gera e como pagar.<\/p>\n<h2>As tr\u00eas figuras, sem disfarce<\/h2>\n<ul>\n<li><strong>Motorista CLT.<\/strong> Empregado da casa, dirige ve\u00edculo da empresa. Custo cheio de folha e encargos, e todas as regras da <a href=\"https:\/\/growthlog.com.br\/conteudo\/jornada-do-motorista-regras-controle\/\">Lei 13.103<\/a>: jornada controlada, tempo de dire\u00e7\u00e3o e descanso, horas extras. Em troca: exclusividade, gest\u00e3o direta, padr\u00e3o de servi\u00e7o.<\/li>\n<li><strong>TAC independente.<\/strong> O aut\u00f4nomo da Lei 11.442\/2007, com RNTRC pr\u00f3prio e ve\u00edculo pr\u00f3prio, contratado por viagem. Rela\u00e7\u00e3o comercial, n\u00e3o trabalhista, com pagamento obrigatoriamente via <a href=\"https:\/\/growthlog.com.br\/conteudo\/o-que-e-ciot\/\">CIOT<\/a>. Flexibilidade m\u00e1xima, v\u00ednculo nenhum, e nenhuma garantia de disponibilidade amanh\u00e3.<\/li>\n<li><strong>TAC agregado.<\/strong> O meio-termo da mesma lei: o aut\u00f4nomo que coloca seu ve\u00edculo a servi\u00e7o da transportadora com exclusividade, mediante remunera\u00e7\u00e3o ajustada. Continua sendo rela\u00e7\u00e3o comercial, mas a conviv\u00eancia di\u00e1ria \u00e9 o terreno onde o v\u00ednculo trabalhista costuma ser plantado.<\/li>\n<\/ul>\n<p>O STF validou o modelo da Lei 11.442 ao julgar a ADC 48: terceirizar o transporte para TAC \u00e9 constitucional, e a rela\u00e7\u00e3o, cumpridos os requisitos da lei, \u00e9 comercial. Mas a decis\u00e3o protege quem opera conforme a lei, n\u00e3o quem usa a lei de fachada.<\/p>\n<blockquote>\n<p>A Justi\u00e7a do Trabalho n\u00e3o l\u00ea o contrato; l\u00ea a rotina. Se a rotina do agregado \u00e9 a rotina de um empregado, o contrato vira papel e o passivo vira realidade.<\/p>\n<\/blockquote>\n<h2>Onde o v\u00ednculo \u00e9 plantado (e como n\u00e3o plantar)<\/h2>\n<p>Os elementos que transformam agregado em empregado na pr\u00e1tica s\u00e3o conhecidos: subordina\u00e7\u00e3o direta (ordem, hor\u00e1rio, puni\u00e7\u00e3o), pessoalidade exigida (s\u00f3 ele pode dirigir), habitualidade de rotina interna e exclusividade f\u00e1tica sem contrato que a preveja.<\/p>\n<p>As regras de conviv\u00eancia que sustentam o modelo comercial:<\/p>\n<ul>\n<li><strong>Contrato escrito de agrega\u00e7\u00e3o<\/strong>, com objeto, remunera\u00e7\u00e3o por produ\u00e7\u00e3o e a exclusividade prevista nos termos da lei, n\u00e3o imposta por costume.<\/li>\n<li><strong>Gest\u00e3o por resultado, n\u00e3o por rotina.<\/strong> Combina-se a viagem, o prazo e o padr\u00e3o de servi\u00e7o; n\u00e3o se gerencia o dia do aut\u00f4nomo como se gerencia escala de empregado.<\/li>\n<li><strong>Pagamento formal sempre.<\/strong> CIOT em toda contrata\u00e7\u00e3o de TAC, sem &#8220;por fora&#8221;. O por fora derruba o argumento comercial inteiro no primeiro depoimento.<\/li>\n<li><strong>Documenta\u00e7\u00e3o viva.<\/strong> RNTRC v\u00e1lido, ve\u00edculo em nome do TAC (ou nos arranjos que a lei admite), ANTT em dia. Frota que <a href=\"https:\/\/growthlog.com.br\/conteudo\/documentacao-frota-vencimentos\/\">controla vencimento de documento<\/a> controla tamb\u00e9m o lastro jur\u00eddico da rela\u00e7\u00e3o.<\/li>\n<\/ul>\n<h2>A conta honesta entre os modelos<\/h2>\n<p>CLT custa mais por m\u00eas e menos por surpresa: o custo \u00e9 alto, mas conhecido, e a capacidade \u00e9 sua. Agregado e TAC custam por produ\u00e7\u00e3o e transferem o investimento do ve\u00edculo, mas cobram em disponibilidade, padr\u00e3o e risco jur\u00eddico mal gerido.<\/p>\n<p>A conta certa n\u00e3o \u00e9 ideol\u00f3gica, \u00e9 operacional: linha regular com carga constante pede n\u00facleo CLT; picos, sazonalidade e pra\u00e7as novas pedem agregados e TAC.
